These GTCS are concluded between

Selah vie, limited partnership (SComm) under Belgian law, with registered office at 4760 Büllingen (Belgium), Manderfeld 2, registered in the Central Database of Companies under number 1012.552.019, as well as in the Register of Legal Persons of the Enterprise Court in Eupen, represented by its managing director, Mrs. Carrie Heiners (hereinafter referred to as "Selah Vie" or "Seller"),

and secondly, any person of legal age (hereinafter referred to as the "Customer") who wishes to make a purchase via the Selah vie website (www.selah-vie.store), which is the exclusive property of Selah vie.

1 - Object

The present terms and conditions govern the sale of all products (by electronic means) presented by Selah Vie on the website www.selah-vie.store and sold through it. 

The conditions in force at the time of the conclusion of the contract on the website shall apply.

The parties agree that their relationship is governed exclusively by this contract, to the express exclusion of any terms and conditions of sale, business or other contractual terms and conditions of the customer. The website www.selah-vie.store is reserved for consumers. The purchase of products by a professional for the purpose of resale is prohibited.

2 - Items and products

The items visible on the website www.selah-vie.store can only be delivered while stocks last. If the product is not available, Selah Vie undertakes to indicate this on the website. Any complaint from the customer concerning the order or delivery of an unavailable item will be considered unfounded.

Selah vie cannot be held responsible for any errors in the description and presentation of the products. The illustrations and photos of the products that support the text are not contractually binding. Under no circumstances can Selah vie be held liable on the basis of these illustrations/photos.

3 - Prices and terms of payment

The prices stated on the website www.selah-vie.store are in euros. VAT is charged at the rate applicable in Belgium at the time the order is placed. Any change in the tax rate will be applied immediately to the current order. All prices in the online shop include VAT and are subject to change at any time without prior notice.

Delivery and shipping costs are not included and are indicated separately in the product description. The buyer will be informed of these additional costs on the overview screen before the final validation of the order. The products remain the property of Selah Vie until full payment has been received.

The payment option(s) will be communicated to the customer in the seller's online store.

4 - Order process

1- Place the item(s) in the shopping cart.

2- Fill in the order form.

3- Check the elements of your order, identify and correct any errors made during the ordering process.

4- Confirm the order and the total price. By confirming your order, you accept selah vie's general terms and conditions.

5- Follow the instructions of our payment partner. Your bank account will be debited with the total price, which includes the total price of the items shipped and the delivery costs.

6- You will receive an electronic confirmation of receipt, which will be considered as confirmation of your order.

7- You will receive your package at the delivery address you specified when placing your order.

5 - Delivery

5-1. GENERAL

The items offered for sale on www.selah-vie.store can be delivered within Europe and to South Africa to the delivery address indicated by the customer on the order form.

5-2. TERMS OF DELIVERY

For all products, the order is prepared for dispatch from the warehouse in Belgium within an average of 3 to 7 working days (subject to stock availability) from e-mail confirmation of the order.

Orders are then delivered through different suppliers. From the moment the carrier takes charge of the order, the customer is delivered at home or to a relay point within the times specified below.

5-3. DELIVERY TIMES AND PRICES

The delivery times announced on the site apply from the time the customer receives the order confirmation e-mail sent by Selah Vie. 

The delivery times announced on the site are purely indicative and depend on the destination and availability of the product ordered. If the delivery time is exceeded, the order may not be cancelled, the price paid by the purchaser may not be reduced and no payment may be made by way of damages. 

Selah vie cannot be held responsible for additional delays caused by failure to provide bank authorization or an incomplete order form. In the event of a partial delivery, the transportation costs will only be charged for the first delivery.

6 – Payment

Customers may pay by different payment options.

Payment methods such as bank transfer and cash on delivery are not accepted. The invoice amount will be debited from the customer's account on the day of payment.

7 - Right of withdrawal

The buyer has a period of 14 calendar days, starting on the day following delivery of the goods, to exercise his right of withdrawal. Within this period, the buyer may therefore request an exchange or return of the purchased item(s) in exchange for a refund of the purchase price paid / a credit note of the same amount.

After this 14-day period, Selah Vie is free to refuse the exchange, credit note or refund.

The buyer must inform Selah Vie within 14 calendar days, starting on the day following delivery, of his wish to withdraw. The buyer will follow the exchange or refund procedure that will be communicated to him by e-mail after completing the form. Selah Vie is not liable for the loss of a parcel by the carrier.

7-1. EXCHANGES

Exchanges are possible if you want to select different sizes of the same product. The exchange will be made for the same item and if the item is in stock. Unless otherwise specified, the exchange will be processed within a maximum of 20 calendar days from the date on which Selah Vie is informed of the customer's decision, provided that the product is returned in its original packaging, in perfect condition, unworn, unwashed, labeled and correctly folded.

Selah vie will bear the cost of the return shipment within the European Union and to the extent that the total amount of shipping costs to be borne by Selah Vie does not exceed the total amount of the customer's order.

If the buyer requests a refund after an exchange, the return costs of 7,95€ will be deducted from the total amount to be refunded and will therefore be borne exclusively by the buyer.

7-1. REFUNDS

An item may only be reimbursed via the Selah Vie website.

If the customer opts for a refund, Selah Vie will refund the customer the price of the product(s), unless otherwise specified, within a maximum of 20 days from the date of receipt of the items, as evidenced by the carrier's tracking, provided that the product is returned in its original packaging, in perfect condition, unwashed, unworn, labeled and correctly folded. If the product is returned in a condition that suggests a use of the item that goes beyond what is necessary to establish its characteristics or that does not allow it to be resold, the purchase price will not be refunded. 

To receive a refund, the customer must first complete the available return form. The further procedure will then be explained by reply e-mail. The refund will be deferred until the products are returned, within a maximum of 7 days after Selah Vie has received the returned products. For this refund, we will use the same means of payment that you used for the original transaction. The costs of returning the product(s) to be refunded shall be borne by the customer. If Selah Vie has sent the customer a return slip, this amount (including VAT) will be deducted from the total amount of the refund to the customer.

It is noted on some items that refunds are not accepted. In accordance with Article VI. 53. of the Belgian "Code de droit économique", certain products such as underwear or swimwear are excluded from the right of withdrawal for hygienic reasons. In most cases, selah vie accepts refunds for products sold on its website, but in certain cases selah vie reserves the right to make use of the exceptions provided for in the aforementioned article of the law and to exclude the right of withdrawal. In such cases, selah vie will exchange the product for another one on the website or offer a credit note valid on the website.

8 - Legal warranties and after-sales service

The products sold are covered by the legal guarantee of conformity provided for in articles 1649bis to 1649nonies of the Belgian Civil Code. The only obligation incumbent on Selah Vie under this warranty is to replace or repair, at its discretion, free of charge, the products found to be defective, without any other service or compensation.

This warranty does not cover damage caused by improper use of the product, normal wear and tear due to use or failure to follow the washing and care instructions.

9 - Privacy policy

In the context of processing the order, forwarding it and issuing the invoice, selah vie must process the Customer's personal data, to which the Customer agrees, whereby the General Data Protection Regulation (Regulation EU 2016/679 of April 27, 2016) and all laws that should replace it and/or deal with the protection of personal data apply. The Seller declares that it complies with the legal provisions of the General Data Protection Regulation.

In particular, selah vie may retain this data for as long as it is obliged to provide any guarantee and for as long as any disputes regarding the purchase agreement, its conclusion, performance and/or termination persist.

The buyer whose personal data is processed has the right to access, rectify and object to the processing of their data. This can be done by sending a request to: info@selah-vie.store, proving identity and a legitimate reason, if required by the General Data Protection Regulation, 

This data may be communicated by selah vie to its contractual partners, but only for the purpose of processing the order and in particular to ensure the transportation of the products ordered.

Depending on the choices made by the customer when setting up his account on the Internet, he may choose to receive offers/advertisements from Selah Vie. If a customer no longer wishes to receive these offers/advertisements, they can request this at any time by sending an email to customer service: info@selah-vie.store

10 - Liability

Selah vie cannot be held liable for any event, inconvenience or damage linked to the use of the Internet network, in particular in the event of interruption of service, external intrusion or the presence of computer viruses.

Selah vie shall also not be liable for non-performance of the contract in the event of unforeseen events, force majeure, interruption or total or partial strike, in particular of postal services and means of transportation and/or communication, flood or fire. Selah vie shall not be liable for indirect damage, operating losses, loss of profit, damage or costs that may result from the present contract.

11 - Attribution of jurisdiction

These General Terms and Conditions and the business relationship between Selah vie and the Customer are governed by Belgian law. All disputes in connection with the business relationship between Selah vie and the customer are subject to the jurisdiction of the Belgian courts.

12 - Customer service 

In the event of complaints and/or disputes relating to the website, these GTCS and/or an order, Selah Vie invites the Customer to contact Customer Service at: info@selah-vie.store

13 - Intellectual property rights

All logos, illustrations, slogans, drawings, photos and models on the website are and remain the exclusive property of Selah vie. Any total or partial reproduction, modification or use of these goods is strictly prohibited and constitutes a counterfeit and an offense.

14 - Legal notice
